FRESNO – A security guard who was involved in a deadly altercation Monday night at the Ritchie Trucking Service yard is not expected to be charged with the death of a Fresno man.
The incident happened just after 8 p.m. on Monday in the 2700 block of East Annadale Avenue. When officers arrived at the scene, they found 37-year-old Morris Linder on the ground with gunshot wounds. Officers attempted to save the man, but he died at the scene, authorities said.
The 26-year-old security guard, who has not been named, was found lying on his back with a broken arm, with a cell phone lying on the ground nearby. He was transported to Community Regional Medical Center.
Police say the security guard was on duty guarding the premises near the Ritchie Trucking Service yard when Linder approached him on Monday night. Linder apparently had been living out of his car, ran out of gas, and approached the guard for money. H asked to use his cell phone, authorities said.
After using the phone, Linder threw it on the ground. Morris then allegedly hit the guard in the face, and both men fell to the ground. Police say Morris was on top of the guard, punching him, when the guard pulled out his gun and shot Morris four times.
Police are trying to determine if Linder was under the influence of drugs at the time of the altercation, for they had received reports that Linder was a methamphetamine user.
The security guard is employed by Falcon Private Security. Chief Officer Michael Safwat said in a statement that the guard “acted in a self-defense situation for himself and the property.”
Although the case is not yet officially closed, police say that the guard will likely not be charged as the shooting appears to be justifiable self-defense.
