41-year-old Hung Alex Truong appeared before the Honorable Hector E. Ramon of the Superior Court on September 16 in Dept 23, for a brief arraignment. Truong on or about Aug 14 was charged with second degree burglary under PC 459/460 (B), when he had entered the Lucky’s store located at 2027 Camden Avenue in San Jose with the intent to commit theft. During that time he committed battery under PC 242/243 (a), when he used force against two employees that were trying to detain him during the incident. Truong was also charged with vandalism under PC 594(a)/ (b) (2) (A).
A statement by store employees revealed that an Asian male, later identified as Hung Truong, entered the store from the produce entrance, and was then seen entering the detergent isle, when he was seen placing ten 96-load Tide detergent bottles into a cart. He then left the store after walking through several aisle ways, and left beyond where all points of sale were possible. Two employees identified themselves as loss prevention staff and asked him to return to the store. However, Truong physically fought against being detained by them. The total cost of the merchandise was $209.90.
Truong was originally charged with strong-armed robbery, since he had refused to comply with loss prevention employees in the parking lot. Both victims sustained minor cuts and scrapes. The suspect also received minor cuts and bruises. During the struggle while they tried to place the suspect in handcuffs, he swung his arms wildly and hit the contract employee several times, while resisting arrest. He refused medical service and was booked into the Santa Clara County Main Jail without further incident. A criminal history check of the suspect revealed that he had two prior offenses against him for resisting arrest under PC 148 (a) in Nov of 2003, and Jan 2012.
According to officers in Troung’s statement “he advised that he was trying to be a Good Samaritan by helping her push out her shopping cart. He said that he believed that she had paid for the laundry detergent and did not realize that he was actually stealing the items.”
Truong then said, “It is not my stuff.” And then said he felt it was actually a “set up”. Officers believe that Truong showed no remorse for his actions. Security footage provided by security staff showed Truong walking through the aisles of the store, as he placed the detergent into the shopping cart before exiting.
