Illegal Firearms Sales Leads to Arrest of Four

Ventura County - An investigation by Ventura County Sheriff Gang Unit Detectives that began with the New Year has apparently become fruitful with the arrest of four men from Fillmore suspected of trafficking in the sale and transfer of illegal firearms.

Martin Gaspar

According to Ventura County Sheriff’s Public Information Officer Cpt. Don Aguilar, VCSD Detectives obtained a search warrant for two residences in Fillmore and served the first one at 10:00 a.m. on January 17th.  The occupant of that home, Arthur Escoto, 27, was found to be a “prohibited person in possession of a firearm,” as well as in possession of a stolen firearm and being under the influence of a controlled substance while in possession of those weapons.  He was ultimately booked into Ventura County Jail on those charges as well as counts of street terrorism and receiving stolen property.

Jasmine Medina

With that notch on their belts, detectives then proceeded to a second location in Fillmore where they contacted Martin Gaspar, 23, Jasmine Medina, 18, and Daniel Cervantes, 22.  Each was suspected of conspiracy in working with Escoto in acquiring and selling firearms, and were determined at the time of their warrant contact to be under the influence of controlled substances and of being in possession of drug paraphernalia.

All four suspects are currently held in custody at Ventura County Jail.

Uptick in arrests over MLK holiday

Vehicle stops involving suspended driver’s licenses and possession of drugs and/or DUI were up due to patrolling enforcement between the CHP and San Jose Police force.  Numbers show more than 30 arrests involving drivers under the influence of an unknown substance while on the road over the Martin Luther King Jr. holiday.  Violent crime also spiked with San Jose’s second and third homicide occurring just days after the MLK holiday.

The Fresno pair found their victims in the busy area of Curtner and Monterey before being spotted by police

On January 20 San Jose Police officers arrested two individuals who were found on Stauffer Blvd.  23-year-old Jonathan Powell and 22-year-old Keenan Reese, both from from Fresno were arrested for PC 25850(a) carrying a concealed firearm in their vehicle, PC 211, Felony Robbery, PC 4574 Weapon/Tear Gas, and PC 496 Possession of stolen property.  These individuals were identified by officers as suspects in committing several robberies in the area, in a follow up from a person reporting being robbed near Monterey Road and Curtner Avenue in San Jose.

The two suspects appeared in an arraignment hearing on Jan 24, however, they did not enter a plea, and were not expected to post bail.

Three robberies had occurred near Curtner Avenue crossing Monterey Road in San Jose.  It is believed that the two suspects, Powell and Reese, were friends working together to rob pedestrians on the street in search of some quick cash.  Police officers doing routine patrol of the area recognized the vehicle description in the robbery and had pulled over the suspects without incident.

Press Information Officer Sergeant Jason Dwyer with the San Jose Police Department said, “The suspects were located driving a vehicle and were stopped in that area. Patrol levels are a priority for increased crime.”

According a to a press release by the department,  San Jose’s second homicide occurred on Jan 23 at the 2600 block of Ponselle Court on a report of a person shot.  The female victim in this case has been identified as 43 year old San Jose Resident Anna Duong.  She is believed to have been shot by her live-in boyfriend.

Press releases by other news agencies are also reporting a stabbing death of a third unknown victim.  There were several suspects involved in the stabbing. However the no motive or name of the suspects is known at this time.

Teacher Accused of Sexually Abusing 20 Students

A Los Angeles Unified School District 4th grade teacher was arrested on Wednesday afternoon for allegedly sexually abusing 20 students along with one adult over the past decade.

57-year-old Robert Pimentel of Newport Beach is being held at the LAPD Metropolitan Detention Center on $12 million bail. The Los Angeles District Attorney’s Office has filed eight counts of sexual abuse and seven counts of lewd acts upon a child against Pimentel. Misdemeanor charges are to be expected as well.

Pimentel was employed by the Los Angeles Unified School District in 1974 until he resigned from his position once the investigation against him commenced.

Complaints from several girls and their parents about Pimentel inappropriately touching them under and over their clothes, lead to the LAPD Juvenile Divisions Sexually Exploited Child Unit to begin their investigation on Pimentel in March of 2012.

Within the past months, the Los Angeles Unified School District has received numerous allegations of sexual misconduct involving teachers and students. A state audit released last November found that Los Angeles school officials failed to promptly report nearly 150 cases of suspected misconduct to state authorities, including allegations of sexual contact with students.

Of the 20 children allegedly abused, 19 were students of Pimentel. The 20th came up while detectives were collecting evidence. The adult was another teacher that had worked with Pimentel.

Upon hearing about the accusations, the teacher’s union of Los Angeles, United Teachers Los Angeles, released a statement, saying “The allegations described are horrific. As teachers we have a duty to uphold the trust our students and their parents place us in.”

Accusations against Pimentel range from September of 2011 to March of 2012. However, during the investigation, detectives found earlier allegations from 2002 and 2008. In the reports, of which were never given to law enforcement officers, Pimentel was again accused of inappropriately touching students. The 2002 incident occurred at Dominguez Elementary and the 2008 incident at George de la Torre Elementary School in Wilmington. Coincidentally, at both schools, the principal at the time of the accusations was Irene Hinojosa.

George de la Torre Junior Elementary School

After the 2002 incident at Dominguez Elementary, Pimentel was then transferred to George de la Torre in 2007, where complaints against him from parents began to turn up the following year.

Magdalena Gonzalez, a parent volunteer for George de la Torre Elementary, complained to Hinojosa about Pimentel. Other volunteers complained to Gonzalez about Pimentel, stating how Pimentel had been caught “playfully spanking” students as well as pulling the bra strap of a student at a 5th grade graduation ceremony.

Gonzalez said that she, along with the other parent volunteers, complained to Hinojosa about Pimentel’s behavior towards students. She said Hinojosa ignored their complaints, and instead allowed Pimentel to stay in classrooms with students despite complaints.

While she was the principal at both schools where Pimentel was accused of sexual abuse, Hinojosa knew about the accusations but repeatedly failed to inform law enforcement authorities of Pimentel’s behavior.

The Los Angeles Unified Superintendent John Deasy said in an interview “I am very angry. You tell me you knew about a complaint and you didn’t act on it? You are gone, and if you touch a kid, you are gone. If you know about it and you don’t report it, you are going to lose your job. We are mandated to report it. It is the law.”

Once the school district found out about the allegations, both Pimentel and Hinojosa were removed from their posts. District officials then prepared a “notice of termination” for Pimentel and Hinojosa, but the two retired before the scheduled meeting.

Deasy said both Pimentel and Hinojosa will receive their full pensions, since they retired before the scheduled meeting could occur.

Deasy added, “Can you go back and fire someone who’s already retired? No, you can’t. They both retired on the same day. It’s clear they did it to prevent me from going to the school board.”

Anyone with information about the case is asked to call Juvenile Detective Division at 213-486-0570. During non-business hours or on weekends, calls should be directed to 1-877-LAPD-24-7 (877-527-3247). Anyone wishing to remain anonymous should call Crime Stoppers at 1-800-222-TIPS or 800-222-8477

Compton assaults and harassment called Hate Crime

COMPTON – The LA Sheriffs Department  arrested three suspects on January 24th for a hate crime committed in Compton, a city with a history of racial tension. According to an LASD press release, 21-year-old Efren Marquez of Riverside County, 19-year-old Jeffrey Aguilar of Compton, and a teenage juvenile were arrested after repeatedly threatening an African-American family after they moved into their gang territory on 153rd Street.

Mug shot or yearbook photo? 19-year-old Jeffrey Aguilar faces multiple charges

The conflict began on New Year’s Eve of last year when one of the male victims was walking home. An SUV containing five Latino gang members approached the victim and told him that he and his family were not welcome because they were black. The suspects continued to threaten him and use racial epithets until the victim, fearing for his life, tried to run the rest of the way home.

The suspects exited the vehicle and pursued the victim on foot before they managed to surround him and beat him with metal pipes. While the victim was being beaten, one of the suspects pointed a gun and threatened to shoot before he and the gang fled the scene in their SUV. The victim later identified Marquez as the suspect behind the gun and Aguilar as one of the gang members who beat him with a pipe.

Thirty minutes later, Marquez and Aguilar returned with 15 to 20 gang members who then surrounded the family’s house. The gang members continued to hurl racial slurs, specifically telling them that “n-words” were not allowed in the neighborhood. At one point, a suspect threw a beer bottle at their window, shattering it. Both Marquez and Aguilar were reported to have been armed.

For the rest of the day, the victims were harassed as the gang members drove by the house three times a day and continued their verbal assault. As a result of the attacks, detectives from the LASD’s Operation Safe Streets Bureau served search warrants at 11 locations in Compton, Gardena, and Rialto on January 24th.

Efren Marquez was identified as the gang member brandishing a gun

During one of those searches in Compton, deputies located the juvenile suspect and arrested him. During his detention, the suspect began to struggle with one of the deputies and reach for the gun in his holster. Surrounding officers were able to further restrain him and prevent the suspect from reaching the firearm. The suspect was later detained at a juvenile detention facility where he was booked for assault on a police officer.

Marquez and Aguilar were also located and arrested. Both were booked at the Compton Sheriff’s Station and charged with a Hate Crime Committed for the Purpose of Violation of Civil Rights with Ability to Commit Violet Injury on Another. Both are being held on $95,000 bail.

According to LASD Deputy Aura Sierra, local deputies are making routine checks as the investigation progresses.

Anyone with information is asked to contact Sheriff’s Operation Safe Streets Bureau gang investigators at (310)603-3100 or the Compton Sheriff’s Station at (310)605-6500.

Shotspotter system alerts police to gunshot victim

$

EAST PALO ALTO – In 2008, East Palo Alto installed a system known as ShotSpotter, created by Mountain View based SST, which installed the first of its systems in nearby Mountain View in 1995.

ShotSpotter, and the more recent version, ShotSpotter Flex, uses a sophisticated wide-area acoustic surveillance, using installed sensors, to identify and pinpoint gunfire anywhere within the targeted area. The system is capable of recognizing a distinct signature sound of gunfire, so backfires, fireworks, and other loud noises are not mistakenly tagged as gunshots. ShotSpotter is currently in use on over 80 locations, in 4 countries, with over 70 in place in the U.S. Police use the system for everything from identifying potential gun crimes, to discouraging citizens from firing shots during New Year’s Eve and Independence Day celebrations.

ShotSpotter helped police find the victim, Jonathan Alcazar, in the 2600 block of Illinois Street in East Palo Alto

At 1:47 in the afternoon on January 14, East Palo Alto Police Department received a ShotSpotter activation report from the 2600 block of Illinois Street. When officers arrived, they found the body of Jonathan Alcazar, 24 years old, riddled with multiple gun shot wounds.  He died on the scene.

A few hours later, another shooting victim sustaining multiple gun shot wounds was admitted into a local hospital. He is in critical condition and police are not releasing his name yet.

The motive, or any possible gang connection is unknown and police are actively investigating suspects. Anyone with information about this crime is urged to contact the East Palo Alto Police Department:

  • Send an anonymous text from your cell phone to 650-409-6792
  • Leave an anonymous voice mail by calling 650-409-6792
  • Call East Palo Alto Police Dispatch at 650-321-1112

Alcazar is listed as the first homicide of San Mateo County in 2013.

Bank robber & car thief arrested

Police released this surveillance image last week, which helped identify the culprit

The Roseville and Rocklin police departments have announced the arrest of a man suspected in two bank robberies and two car thefts.

On Tuesday, January 22nd at 12:45 in the afternoon, the U.S. Bank located inside Safeway Grocery at 989 Sunrise in Roseville was held up by a man described as white, mid to late 20s, with a scruffy beard and wearing large winter gloves. With his sunglasses perched above his eyes, he was caught in the bank’s surveillance camera as he made off with an undisclosed amount of cash. He showed no weapon, but presented the teller with a note demanding the money.

The US Bank inside this Safeway was robbed last Tuesday 1/22

Apparently happy with the results, that Friday he visited another U.S. Bank branch in the Safeway at 9045 Woodcreek Oaks, and using the same modus operandi, made off with cash from that branch as well.

In the meantime, the released surveillance photos prompted an anonymous tip to Roseville Crime Stoppers from someone who recognized the bank robber as Randy Penny. Once identified, Roseville Police detectives were able to connect him to two car thefts, one in Sierra Gardens, a neighborhood near the first bank robbery, and another from the town of Antelope, which is in North Sacramento County near Roseville.

The US Bank in this Safeway was robbed 3 days later

According to a Roseville Police press release, at 1:42 AM this morning (Tuesday 1/29), a Rocklin police officer on routine patrol spotted a suspicious car at Sierra College Blvd. and Taylor Road. When the officer ran the plates, it was identified as one of the cars Penny was suspected of stealing. The officer pulled him over and arrested Penny without further incident. Roseville detectives were notified of his arrest, and booked the 31-year-old Antelope resident into Placer County Jail on charges of robbery and vehicle theft.

Randy Wesley Penny was booked into Placer County Jail on multiple charges

The detectives are also recommending that the anonymous tipster be given a cash reward from Roseville Crime Stoppers.

Man Arrested for Allegedly Setting Church on Fire

EL CAJON – As the members of Saint Gregory of Nyssa Greek Orthodox Church gathered for a service on Sunday morning, January 27, they were stunned to see their church ruined after a fire.

Darin Williams, 38

According to the San Diego County Sheriff’s Sergeant E. J. Dayrit, the sheriff’s deputies, along with the fire personnel, were dispatched to the 1900 block of Mary Ann Ave of El Cajon early Sunday morning, at about 4:00 am, as they responded to a call from a local resident.

As they arrived, they found the Orthodox Church in flames and the neighbor reported that they heard a man yelling and then saw smoke coming from the church’s patio. The fire personnel worked quickly and managed to stop the fire in less than an hour. However, the church building, which the members were planning to rebuild,  suffered damage of about $250, 000.

Investigators from Sheriff’s Bomb/Arson Unit and the federal Bureau of Alcohol, Tobacco, Firearms and Explosives were called onto the scene for investigation and eventually identified Darin Williams, 38 as a person of interest.

St. Gregory of Nyssa Greek Orthodox Church before the fire

According to Reverend Simeon Corona, Williams attended the church and even rented a room from one of the parishioners. Moreover, he was recently released from a psychiatric hospital. Williams got very upset when Corona told him that he could no longer stay in the room he was renting unless he was taking his medications.

Williams was contacted and arrested by the police less than ten hours after the fire. He was booked into the San Diego Central Jail and charged for arson, burglary, and a hate crime. He is scheduled to appear in the court on Wednesday at 1:30 pm.

The church members began to recover their building and set up an altar in the church garage with the icons and other items that survived the fire. They held their service there and are thankful no one was injured in the incident.

Robbery suspects plunge stolen Highlander under water

The victims live in this San Jose neighborhood. It is not believed that they had any prior connection to the three assailants.

Three suspects are now in custody for armed robbery, false imprisonment, assault with a deadly weapon, kidnapping and burglary associated with the home invasion of a 73-year-old man and 76-year-old woman in the 6700 block of Bret Harte Drive in San Jose on Jan 21.  19-year-old Miguel Marez, 18-year-old James Palmerson, and 18-year-old Ezra Santana are also suspected of committing three other robberies between Jan 19 – 21.

(Palmerson was known as the 14-year-old boy who stole his grandparents car in 2009 and drove with his 13-year-old girlfriend to Denver, nearly freezing before authorities found them after they tried to use the grandfather’s ATM card. See Mercury News story linked below.)

The elderly couple had been tied up by the suspects. However once the suspects had fled in the couple’s vehicles, they were able to untie themselves and call police.  Police do not believe that the suspects knew the elderly couple, and feel  it was unfortunate that they were targeted by the trio.

Miguel Marez

The couple’s Toyota Camry was found abandoned in Hollister just hours after a high-speed chase was terminated due to unsafe driving conditions.  According to a press release by the San Jose Police Department, “The California Highway Patrol was involved in a high-speed pursuit with the Camry on Highway 152, which exceeded 100 miles per hour.”   The Toyota Camry was later recovered along 152 near Highway 101 in Hollister.

During the search for the vehicles by the San Jose Police Department and other agencies, a call received by the Santa Clara Sheriff’s department reported suspicious behavior at the Uvas reservoir near Morgan Hill. During the investigation into the incident, the couple’s Toyota Highlander was found submerged under water in an apparent attempt by the suspects to thwart police efforts in capturing them.

James Palmerson

Patrol officers located Palmerson on Thursday Jan 24, just three days after the attack.  The Covert Response Unit was also able to arrest Marez later on that afternoon.  Santana was located the next day by the CRU in Gilroy and arrested.

Ezra Santana

In the press release Acting Chief Larry Esquivel stated, “Our Robbery Unit’s hard work not only solved a violent home invasion, but they solved three other violent robberies as well.  I’m proud of the hard work of our detectives and patrol personnel.  Working together, they took three very violent criminals off the streets of San Jose.”

SANTA CLARA SHERIFFS INVESTIGATE SHOOTING AND DEATH

On Sunday Jan 27, a 30-year-old man was found dead in his Morgan Hill home. The man was found during an ongoing investigation by Sheriff’s Deputies investigating a call to the Santa Clara County Communications 9-1-1 center reporting gun fire.  During the investigation officers found an unconscious male found in his home on the 14000 block of Oak Valley Road near Sheila Avenue in unincorporated Morgan Hill around 3:00 am.

A press release by Sgt. Jose Cardoza of the Santa Clara Sheriff’s Office at 8:45 am on the same day revealed an ongoing investigation into the death of the individual.  It is not believed that  foul play was involved in his death.

“It was purely a coincidence that the two incidents happened at the same time,” Cardoza said. “The death is not being considered a homicide.”

Sheriff’s Deputies performed C.P.R., however they were unable to revive the victim.  He was later pronounced dead at the scene.   “Investigators are waiting for an autopsy report to confirm the cause of death,” Cardoza said.

SANTA MARIA – Police have arrested two known gang members in connection with an alleged drive-by shooting that happened late Saturday morning.

Uriel Delgado

Pedro Ramirez and Uriel Delgado, both documented Santa Maria street gang members, were arrested Saturday and Sunday, respectively, and booked at Santa Barbara County Jail on suspicion of attempted murder for their roles in the alleged drive-by shooting, police said.

Both men are also facing an enhancement charge of being a known street gang member when the alleged shooting occurred.

Officers were called to the area of Curryer and Cypress just before noon on Saturday, Jan. 26, for reports of shots fired. When police arrived at the scene, they also heard gun shots. Their investigation revealed that a vehicle drove by the residential neighborhood, where children were playing outside, and fired at the victim.

Pedro Ramirez

The unidentified victim was located at Marian Medical Center, suffering from a single gun shot wound. Police aren’t releasing the individual’s identity.

After an exhaustive search for the shooter by Santa Maria Police Department gang detectives, the suspect vehicle was located, which led to the identification and arrest of both the alleged driver and shooter, police said.

Ramirez, 21, was arrested late Saturday evening, and Delgado, 22, turned himself in at the Police Department the following morning. At the time of the shooting, Ramirez, a parolee, was on post community release supervision as a result of AB109.

Burglar meets police with TV in his hands

Vacaville – Dalmacio Fernandez, a 29-year-old Vacaville resident, was arrested late on Sunday for burglary and possession of methamphetamine, both felonies.

Police were called just before midnight on Sunday about unusual activity at a home in the 300 block of Buckeye Street. The call was from a neighbor who had noticed odd noises coming from inside the home and that the side door to the home’s garage was slightly open.

An alert neighbor on Buckeye Street saw suspicious activity and alerted police.

When officers arrived they discovered a side gate to the home’s backyard was open. They also saw tools on the ground near the side door to the garage, and that the door had recently sustained damage. At that point someone came out of the garage carrying a large television. The suspect was identified as Dalmacio Fernandez. He also had stolen property in his jacket pockets from his foray into the home.

Officers attempted to cuff Fernandez but he struggled with them and kept trying to reach into the pockets of his pants. It was later discovered that what he had in there were methamphetamine and related paraphernalia.

Investigation of the premises showed that two doors to the home had been forced, and that more property inside the home had been organized into piles as though Fernandez planned to return for those belongings as well.

Anyone with information about this incident is asked to call Officer Robert Horel at (707) 449-5200. If you see anything that indicates a burglary or other crime is taking place in your own neighborhood, please do what this alert neighbor did and contact your police department.

Man Shot and Killed by Deputies Identified

FRESNO – The man who died after an officer-involved shooting Monday evening has been identified.

Randall Lee Davis

Randall Lee Davis, 51, died after being shot by a Fresno County sheriff’s deputy in what was apparently a “suicide by cop” incident, according to the sheriff’s department.

Around 5:25 p.m. on Monday, someone called 911 to report a man acting suicidal in the 5000 block of East Thomas Avenue, near Willow Avenue and Highway 180. A deputy responding on the scene was immediately confronted by Davis, who had a box cutter in his hand.

The deputy fired one shot at Davis, but his gun wasn’t working properly, and Davis was able to jump on the deputy and start fighting with him, Sheriff Margarat Mims said.

The two continued to struggle against each other and the fight moved into the street when a second deputy arrived on the scene. When he saw what was happening, he fired his gun and hit Davis.

“Thank goodness the second deputy that arrived was able to put an end to the fight to keep his beat partner from being injured,” Mims said.

Davis, who has a criminal history, died at the scene. Authorities said he had already cut himself several times by the time the first deputy showed up on the scene.

Both the deputies involved in the incident are on paid administrative leave.

ROSEVILLE – On Sunday night a citizen returned his rental car to a local agency and discovered that the key drop box had been broken into, whereupon he promptly called the police, who arrived on the scene along with some of the rental agency’s employees.

Gary Lee Fowler

They confirmed, upon checking the lot, that six rental vehicles were missing.  A search of the area revealed that five of the missing cars were parked elsewhere in parking lots in the area.  A 31-year-old Citrus Heights woman was arrested near one of the stolen cars on suspicion of vehicle theft and possession of methamphetamine.

Further investigation revealed the identity of another suspect – Gary Lee Fowler.  Two nights later officers observed the remaining stolen vehicle being driven by a male near Loretto Way and Quail Circle.  As they followed the vehicle, the driver led them on a brief pursuit and then fled the vehicle on foot on King Road.

An extensive searching ensued that involved officers from Roseville, Rocklin, Citrus Heights, and Placer County, as well as helicopters from CHP and Placer County.  They unfortunately were not able to apprehend the suspect, whom they believe was Gary Fowler.

The public is asked to call Roseville Crime Stoppers (916)783-STOP if anyone has any information on Fowler’s whereabouts.  You may also go to www.roseville.ca.us/police and select the “submit a tip” tab, or text a tip to “CRIMES” (274637) and start your text with the word  ”ROSEVILLE.”
