Santa Barbara – Santa Barbara, known as a vacation playground for most, has also been known lately as the scene of an alleged assault at the County Jail system at the hands of two deputies.

Two Santa Barbara County Jail Custody Deputies were arrested on charges of the use of unnecessary force under color of authority pursuant to said alleged assault upon an inmate residing at the jail.

According to Santa Barbara County Sheriff’s Public Information Officer Kelly Hoover, the complaint was “brought to our agency’s attention by the Public Defender’s Office on June 18, 2013,” whereupon an investigation into the matter promptly ensued.

The custody deputies involved are Robert Kirsch, 30, and Christopher Johnson, 28.  Each has been charged with felony assault by a public officer as detailed in the criminal complaint issued by Santa Barbara County District Attorney Joyce Dudley.

Clearly finding himself at the eye of a local media storm, Santa Barbara County Sheriff Bill Brown addressed the issue by saying, “Our agency does not tolerate the unnecessary or excessive use of force.  The behavior alleged in the criminal complaint is contrary to the high standards of the Santa Barbara County Sheriff’s Office.  I am saddened by these allegations that do not reflect theconduct and actions of the vast majority of the hundreds of men and women of the Sheriff’s Office who dedicate their lives to protecting and serving others.”

According to Hoover, booking photos of the arrestees in this case “are not available”.  Arraignment of Kirsch and Johnson is scheduled for August 30, 2013.

Victim Chases Armed Robbers Before They’re Nabbed by Police

SAN BERNARDINO – Four suspects arrested Friday on armed robbery charges were scheduled to be arraigned on Monday.

The broad daylight armed robbery attempt in the 1500 block of East Coulston Street in San Bernardino eventually led to police pursuits both in vehicles and on foot in the Los Angeles area. Charles Smith, 34, Khalid Muhammad, 33, and Trayvone Jackson, 33, all of Los Angeles, reportedly followed the victim home from an area bank at 12:45 pm in a silver vehicle.

The armed robbers followed the victim to this tree-lined street, where they robbed him on the side of the road.

San Bernardino Police reported that the three suspects approached the victim, one pointing a handgun at him, ordering him out of his car. The victim was forced at gunpoint to lie on the ground while suspects removed cash and a wallet from his pockets. After the suspects fled, the victim called 911 and began to pursue the suspects on his own. Police said the victim trailed the suspects into nearby Colton where the suspects pulled over and pointed a handgun at him.

“The victim feared for his life,” said Lt. Paul Williams, spokesman for San Bernardino Police, “and was unable to continue the pursuit of the suspects’ car.” The suspects fled back to the Los Angeles area.

Williams said officers later found the suspect’s car and attempted to make a traffic stop. Reports are that the suspects failed to yield, resulting in lengthy high speed pursuit that ended with a foot pursuit. All three suspects were eventually caught. A fourth suspect, Aiesha Jones, 34, was later found and arrested.

All four suspects were transported back to San Bernardino and were being held at the Sheriff’s Detention Center on charges of conspiracy, robbery, assault with a firearm and street terrorism.

Fairfield Man Drowns Family Dog, Pleads Innocent Due To Impaired Memory

FAIRFIELD– Fairfield City Hall/Civic Complex workers were shocked and dismayed to witness Bryan Cavanah carry his family pet pit bull, “Kia,” out into a scenic pond behind the building and drown her.

Bryan Cavanah

Several witnesses told NBC Bay Area News that on the morning of August 14 they observed Cavanah repeatedly push Kia’s head underwater until she finally died. One witness, Luis Huezo, told KCRA News that he yelled out at Cavanah to stop killing the dog, but that he was ignored.

Cavanah admitted to the authorities that he killed the three-year-old dog belonging to his father, Ronald Cavanah, but was unsure how that transpired. In a strange jailhouse interview, Bryan Cavanah told a KTXL reporter that he’d never hurt his father’s dog; he only realized Kia was dead when he emerged from a “trance state.”

“I was bawling out tears because I loved that dog … she was like a therapy dog to me,” Cavanah said. “How could I be a murderer if I didn’t know I was doing that?”

Ronald Cavanah inexplicably stated that he does not hold his son responsible for the dog’s death. He told KXTL News that Bryan was in a “trance epileptic state.”

The lake at Fairfield City Hall, where Cavanah is accused of drowning the dog.

“It wasn’t his fault. I don’t even understand how he could be in jail for this because he has no recollection of what he was doing. He would never hurt that puppy,” said Ronald.

Nevertheless, Bryan Cavanah was charged with felony animal cruelty. In fact, this was not his first brush with the law. At the time he killed Kia, he was on probation for assaulting a teacher in 2010.

DIXON, CA – Responding to a report of sexual assault about 7 pm on August 14, Dixon police arrived at an apartment complex near downtown Dixon and contacted the female victim at that location.

Jimmy Lavalle Jr. has maintained a Facebook page where these pictures of him were posted. He lists his workplace as "Smoke Weed, F*** the World" - his school is listed as: "University of Go F*** Yourself"

As the investigation continues, Dixon police have revealed few details beyond the identity of the alleged perpetrator, 38-year-old Jimmy Lavalle Jr. of Dixon. Dixon Police spokesman Lieutenant Nathan Steele stated, “There is a state law that specifically mandates we protect the identity of victims in certain crimes and sex crimes is one of them.” Steele also explained that the investigation could be jeopardized if certain aspects of the case that have come to light were disclosed at this time.

Steele did indicate he was able to state that the 20-year-old victim and Lavalle did not know each other before he assaulted her on the grounds of the apartment complex, located at 252 West H Street, near the corner of Adams Street. Steele stated that the assault did not take place inside an apartment.

After interviewing the victim, Dixon police initiated a thorough, wide-ranging  investigation that resulted in Lavelle’s capture without incident about 1 pm the next day.

Police responded to this apartment building on initial reports of the assault.

Booked into Solano County Jail, Lavelle now faces a great many felony charges that include impersonating a police officer, terrorist threats, kidnapping, false imprisonment, assault with a deadly weapon and sodomy.

A bail enhancement to $500,000 is now in force, Steele said, and Lavelle remains lodged at Solano County Jail.

Anyone with further information on these alleged crimes is asked to contact Dixon Police Department Investigations Division at 707-678-7070.

Burglary crimes in Milpitas are not uncommon

Deshawn Dante Davis was arrested after breaking into St. John's Church

MILPITAS – 27-year-old Deshawn Dante Davis was arrested by the Milpitas Police Department on August 11 for Commercial Burglary and being in possession of Burglary Tools. Davis was a known transient in the area, and had been canvassing several areas before he struck. He was arrested near the scene at 279 N. Abel and Junipero Dr, in Milpitas after breaking into St. John the Baptist Catholic Church nearby.

Then on August 12, 27-year-old Michael Joseph Delao and 34-year-old Sonny Michael Francis were arrested for commercial burglary and conspiracy to commit a crime near 1331 California Circle and Cadillac Drive in Milpitas.

During the week the Milpitas Police Dept receives more than a dozen phone calls reporting suspicious circumstances. In many cases no incident is reported.

A more serious incident occurred on August 17 – the MPD responded to a call reporting a home invasion robbery early Saturday morning. Officers quickly responded to a residence on Pinard Street in Milpitas. Victims reported that two unknown Black or Hispanic males had forced their way into the residence sometime between 1:00 and 2:00 a.m. According to Lt. Max Nobidia with the Milpitas Police Department, “two suspects armed with handguns entered the residence and stole property from the home.” Victims did not face life threatening injuries. One resident at the scene was able to call the Milpitas 9-1-1 Dispatch Center some time after 2:45 am once the suspects had fled.

The home invasion suspects left their car and fled on foot, prompting a search of this neighborhood.

Officers were able to locate a vehicle and attempted a felony stop when the two occupants of the vehicle ran from police. A perimeter search of the neighborhood yielded little results, as the occupants of the vehicle were able to escape capture from Milpitas and Fremont police, who joined in the search due to a neighboring boarder line between the two cities. Lt. Nobidia stated, “Police Officers stopped a vehicle on the 2200 block of Devon Place, and two suspects ran from the vehicle.”

Based on further investigation at the scene it was believed those two individuals were likely responsible for the robbery. Anyone with information regarding this case or similar incidents occurring in the city is encouraged to call the Milpitas Police Department at 408-586-2400.

Woodland Driver Leads CHP On Life-Threatening 100 mph Chase

WOODLAND – During a high-speed chase on the evening of August 18, the driver of a 2002 BMW 330CI refused to acknowledge a pursuing CHP officer or, eventually, to get out of his car, which led to his arrest.

Example of a 2002 BMW 330 CI

Alejandro S. Leon, 20, of Woodland was first observed at about 9:35pm by a CHP officer as he sped along Main Street in East Woodland near the Highway 113 onramp.

The CHP officer attempted to pull alongside Leon at the intersection of Pioneer and Main Street. At that point unidentified, Leon hauled. Turning up the I-5 southbound onramp he hit speeds upwards of 100 mph. According to a CHP spokesman, Leon proceeded to briefly tailgate several cars while dangerously switching lanes before swerving to the right of a pickup truck onto the shoulder.

Leon rocketed onto the County Road 102 offramp. The CHP officer switched on lights and sirens. Leon, apparently unnerved, almost lost control of the vehicle on the curve. He screeched and swerved to a stop under the red light at the intersection of the offramp and Road 102.

As the CHP officer approached the BMW, Leon exited the vehicle. “He was yelling something,” said a CHP Woodland office spokesman, “but the officer couldn’t tell what it was about.” The officer ordered Leon to get on his knees while he affixed handcuffs. Leon refused and “aggressively approached the officer.” It was necessary “for the officer to physically take control of Leon.”

Leon was charged with speeding, resisting arrest and quietly booked into the Yolo County Jail.

A man from Merced, CA, has been arrested after transporting a 14-year-old girl across the country without the permission of her legal guardians, according to an official press release from the Sacramento County Sheriff’s Department.

Nathan Salas

Nathan Salas, 27, was arrested on August 19, 2013, at the Sacramento International Airport and booked into the Sacramento County Main Jail. He was reportedly charged with intentionally concealing a child without parents’ consent and is being held on $100,000 bail.

According to the Sheriff’s Department, on August 19 the minor female victim was reported as a missing person by her parents in Hamden, Connecticut after leaving a suicide note and disappearing from home. The Hamden Police Department reportedly conducted an intensive search to locate her and entered her into a national database as a missing juvenile. Hamden PD also conducted forensic analysis of the victim’s phone and obtained a cellular phone number for Salas, who was discovered to be from Merced.

Sacramento International Airport reportedly received a call from the Merced County Sheriff’s Department about a runaway whose parents had reported missing. Further investigation revealed information about flight arrangements for Salas and the victim from Connecticut to Sacramento. Investigators reportedly believe Salas and the victim met online, where they developed a relationship over several months.

Some media reports indicate that Salas met his victim on the website "Spellsofmagic.com"

At approximately 10:30pm on August 19 Sheriff’s deputies reportedly made contact with Salas and the victim as they deboarded their inbound flight at the airport. Deputies also contacted the victim’s father in Connecticut and he confirmed the parents did not know Salas and had not given their daughter permission to leave with him.

After Salas’ arrest, the victim was reportedly transported to the Sacramento County Juvenile Hall as an out-of-county runaway.

Alert Neighborhood Watcher Helps Davis Police Nab Would-Be Burglars

DAVIS—Two Solano County men who allegedly attempted to break into a Davis residence on Drake Drive were arrested due to a neighbor’s call to police reporting the incident at about 2:45 am August 18.

Looking Down Drake Street

Davis Police spokesman Sgt. Frank Tenedora said the caller informed police dispatchers that the two men had just left the residence they’d vandalized but had not succeeded in entering. The caller was able to provide detailed descriptions of the men and their vehicle. The neighborhood watcher stated the failed early morning burglars were headed toward Sycamore Lane in West Davis.

Davis police quickly identified and stopped the vehicle. In the course of their subsequent investigation, officers determined that the driver, Manuel Tavizon, Jr., 25, a Vacaville resident, had been driving under the influence on a suspended license.

The witness was called to where police had stopped the vehicle and identified Tavizon and his passenger Juan Juarez-Ramirez, 24, a resident of Dixon, as the men the witness had earlier seen attempt to break into the Drake Drive residence.

Davis police did not reveal whether the duo had randomly targeted the Drake Drive residence.

Tavizon and Juarez-Ramirez were jailed on charges of suspicion of vandalism and, for Tavizon, DUI.

BAKERSFIELD — Deputies arrested six people and confiscated over 40 pounds of methamphetamine on Tuesday during two major drug busts.

Bakersfield Law Enforcement Displays Seized Meth

The first, occurred in the morning of Aug. 21, when narcotics investigators from the Kern County Sheriff’s Office Major Violator Unit pulled over three subjects suspected of being in possession of large amounts of methamphetamine in the 6900 block of Longford Court in south Bakersfield.
Deputies said that they discovered 10 pounds of suspected meth located in a diaper box in the back seat of one of the two vehicles the suspects were driving.

Taken into custody were: Pedro Ochoa-Monzon, 45, of Phoenix, Ariz., Cecil Hernandez, 32, of Avenal and 23-year-old Elmar Ochoa-Hernandez of Los Angeles.

All of the suspects were booked into the Kern County Jail for possession of methamphetamine for sales, transportation of methamphetamine and conspiracy.

Immigration detainers were also placed on Hernandez and Ochoa-Hernandez after they were determined to be illegal aliens by Immigration and Customs Enforcement officials.

The street value of the seized drugs is estimated at $363,200.00.

Later that same day, the Kern County Cal-MMET concluded a second, unrelated undercover investigation in a south Bakersfield restaurant parking lot where officers said they located approximately 22 pounds of methamphetamine in a sealed bag of dog food in the trunk of a car.

Officers arrested 47-year-old Milpitas resident, Diego Solis, Sandro Solis, 38, of San Jose and  Patricia Andrade, 26, from Porterville.

All three  were booked into the Kern County Jail for possession of methamphetamine for sales, transportation of methamphetamine and conspiracy.

According to police, an immigration detainer was placed on Sandro Solis, who was determined to be illegal.

Investigators later capped the bust with a search warrant at an apartment in the 900 block of Ohio Street in Porterville, where they found an active meth lab as well as an additional seven pounds of methamphetamine and approximately eight gallons of methamphetamine solution.

Additional charges of manufacturing methamphetamine will be requested with the District Attorney’s office for Sandro Solis and Patricia Andrade.

The street value of the methamphetamine is estimated at approximately $1,089,600.00.

San Jose police investigate city’s 31st homicide

Photo from the aftermath at Hoang Hon restaurant/Bar

SAN JOSE – San Jose police are investigating the city’s 31st homicide after unknown suspect(s) shot into a local Vietnamese bar & restaurant named Hoàng Hôn (or Sunshine).  The shooting occurred near the 2800 block of Alum Rock and Pleasant Ridge Avenue sometime after 10:00 pm Monday night.  Three people were injured when more than five bullets ripped through glass, walls and tables, with one bullet exiting the rear of the business through a heavy wooden door.

One patron, who was at the restaurant during the attack, stated that the restaurant hosts several different types of parties –  the restaurant offers beer, alcohol, and even partitioned rooms for patrons who request lap dances from topless dancers.

5 bullet holes were found after the shooting

When speaking with Officer Albert Morales with the SJPD about possible illegal activities he said, “If illegal activities are found to be occurring on the premises, the Vice Unit would be called in to investigate.” In that case, San Jose’s Vice Unit would be handed the case, and they would follow up on the investigation in order to determine the past history of the bar or restaurant, and follow up on incident reports related to these kinds of activities.

A follow up investigation could reveal whether possible illegal activities, including topless dancing without a permit, prostitution and/or drug sales, were occurring on the premises.   Reports could also show a possible correlation to other types of crimes, such as vehicle thefts, attempted burglary, or property damage. This could warrant the closure of the business and possible prosecution by the Santa Clara District Attorney’s Office.

An individual who did not want to be identified said, “I was stunned and shocked to learn about my friend who was shot in the head. That’s why I came here.” He said, “I learned from his Facebook page that he was dead after his wife posted it online.” The victim who later died from a head wound was reported to have worked at a tech firm in Sunnyvale. Two other patrons who were also hit by the gun fire were not seriously injured.  They were treated at a local hospital and released.

After the shooting, the staff had a lot of clean up to do.

By late afternoon, the restaurant manager together with several workers, began the daunting chore of cleaning up the blood and trash that filled room from the night before. Others were called in to replace the door and windows revealing 5-bullet holes found in three separate sites near the front of the business. Others who work and live near the scene were still visibly shaken by the incident.

The San Jose Police Department has increased patrols in “hot spot” areas, making it less likely for gang violence to occur in known gang areas. In 2012 there were a total of 7094 violent crimes reported, with 45 of them homicides. With 31 homicides occurring this year, 2013 is seemingly making its way to becoming an increasingly violent year.

Paso Robles police are looking for a suspect(s) who allegedly exposed his genitals to two women on separate occasions.

Suspect fled in this vehicle

According to PRPD, the first incident occurred on Friday at approximately 11:34 a.m.

A woman flagged down a PRDP officer in the parking lot of a shopping center in the 2300 block of Theatre Drive. She reported she had been the victim of an indecent exposure which just occurred.

The victim said she had been walking to her vehicle when the suspect drove next to her in his vehicle. The suspect yelled at the victim to get her attention, and when she looked over at him she saw he was exposing his genitals and appeared to be masturbating.

The suspect drove away and officers were unable to locate the suspect.

The victim described the suspect as a white male adult last seen wearing a black t-shirt, blue jeans and a dirty green baseball cap with white lettering or a white logo on the cap, who fled in a black Honda Civic.

The second incident happened on Monday at approximately 11:02 a.m.

Police say they received a report of an indecent exposure which had just occurred in the parking lot of the McDonald’s restaurant in the 2700 block of Black Oak Drive.

Officers said the female victim was helping her children out of their vehicle when the vehicle parked next to hers began to exit its parking stall.

The victim called the police but attempts to locate the suspect, who is described as a white male adult, 20-25 years old, heavy-set, were unsuccessful. SAN JOSE – 30-year-old Jerry Low Thomas was arrested on July 29 for an attempted armed robbery that occurred at St. James Park near the corner of North 2nd Street and St. John Street. Thomas approached a person who was standing near the public restroom waiting for his turn, and began to brutally beat him and demand money from him.

The victim, like this man, was waiting to use the restroom when attacked by Thomas

Charges are being filed against the defendant under PC 664 in the attempt of second degree armed robbery under PC 211-212.5 (c). During Thomas’s attempt to take money from the victim, he is also being charged with PC 12022 (b) (1), for the use of a 3.5 inch black handled pocket knife during the commission of the crime.

The victim reported to officers that he was downtown doing some banking when he needed to use the outside restroom, and began to stand near the door, when he was quickly approached by the suspect. Thomas knocked the male victim to the ground and punched and kicked him in the arms and legs, while also punching him several times in the face.

SJPD officers, who were called by the victim to the scene, saw visible signs that he had been beaten by the suspect, however his wounds were non-life threatening. Believing that the suspect may still be in the area, officers took the victim near St. James Park. He and officer were able to locate a possible suspect based on the victim’s description. The victim described him as an African American male, with a black hat and Red Bull symbol in the middle, and an orange jacket with black stripes in the back. The victim said in Spanish to the officer, “Creo que es el, (I think that’s him).” Thomas was stopped and searched.

Law Enforcement presence on the scene were able to identify and capture the Thomas.

A black handled knife recognized by the victim was found on his person. While detained by SJPD Officers the suspect he began to mumble and talk incoherently, saying odd things. During Thomas’s brief court appearance he also mumbled and began saying odd things. Thomas showed little remorse for his actions as he stood before the courtroom mumbling incoherently. Thomas said, “You think I did it.” “Alright,” he said. When asked to be quiet by the district attorney he ignored them and continued to speak over the judge.

Bail was set at 200K by the Honorable Daniel Nishigaya. A Santa Clara Public Defender was also appointed on his behalf during his brief appearance despite his intention to disturb the court. The next plea hearing was scheduled for August 26 at 1:30 pm in Dept. 38 at the Superior Court in San Jose.
