Shooting report leads to seven Santa Rosa arrests

The house was built something like a fortress. On the southeast edge of Santa Rosa the properties are somewhat larger with lots of open space, with a few junkyards in the area as well. 3705 Finley is right at the curving corner of Finley Street and Fresno Avenue. The residents put metal grating on the windows to secure them. Video cameras were installed in several places for surveillance. And there were guns inside – an AK47 and an SKS – a vintage Soviet made semi-automatic rifle that was the precursor to the AK47. Ten other firearms were also on hand, and there was also a pretty extensive marijuana growing and processing operation.

Several people were there Monday morning, October 13, hired on to assist with the processing. According to the Santa Rosa police, one of the men, 32-year-old Isidro Bello-Rosales, got into an argument with his employer about compensation. The argument got heated enough that Rosales decided to run away, apparently without any payment at all. What followed his exit, according to him, was a hail of gunfire.

Rosales fled the house to this area a couple blocks away.

Rosales fled the house to this area a couple blocks away.

Rosales was not shot, but hearing the guns, he called 911 and reported the incident, and said he thought someone else had been shot. Santa Rosa Police rushed to the scene, and found Rosales a couple of blocks away, at the corner of Fresno and New Zealand, at the entrance to a newer, upscale housing development. He told the officers where the shooting took place, and what had happened. After taking his story, officers searched Rosales and found a bit of methamphetamine on him.

The officers then turned their attention to the potential murder scene at Finley with the aim of finding the shooters and possible victims. Their approach revealed a much calmer environment than they expected. One woman was outside, and just inside the door they found several more women and two children. (All subjects were described as Hispanic.) Four men, either on a rest break, or surrendering to the incoming officers, were found lying on the floor next to a bedroom and the laundry room. Surrender is more likely, as they were right next to several open boxes with one-pound bags of processed marijuana. The men were all detained.

The next group of men were not so docile. While trying to open the next bedroom door, the officers heard people inside. After forcing the door open, it appeared the occupants had fled out the back.

Two of the suspects tried to leave the house next door before getting caught.

Two of the suspects went over the fence and tried to leave the house next door before getting caught.

Officers outside the home at that time saw two men casually leaving the house next door. The two, however, were obviously not residents of the home (later confirmed) and they – Adolfo Avendano Lopez, 31, and Martin Sarmiento Morales, 45 – were detained. Like Rosales, Morales had meth with him. With the six men in custody, and the home secured, SRPD Narcotics and Property Crimes units came on scene, and obtained a search warrant. They found 36 live marijuana plants and 230 pounds of processed marijuana, along with $14,000 in cash and the weapons.

Further investigation, and interviews with the suspects, revealed that most of the marijuana had been grown elsewhere, and brought to the location for processing. The on-site staff had been brought in and were being paid an hourly wage to trim and process the marijuana for sales. No one tired to claim it was medicinal, but then no one volunteered that he was the boss or identified any of the others as their employer either.

In addition to Rosales, Lopez, and Morales, police arrested Claudio Jimenez-Avendano, Erik Almonte-Mondragon, Sergio Sanchez-Sarmento, and a minor, who was not named by police. All were charged with cultivation of marijuana, and Morales and Rosales were also charged with possession of a controlled substance and paraphernalia. Final charges will likely be determined upon further investigation and identification of the entrepreneur running the operation. Anyone with any helpful information is encouraged to call the Santa Rosa police at 707-543-3600.

Gang member attacks patrons at McDonalds

Two victims had been eating at a McDonald’s restaurant in San Jose last year when 20-year-old Fernando Fernandez approached and robbed them. It was on March 20, 2013, Fernandez had robbed two individuals of personal property and cash. The act itself wasvery frightening – not only the fact that he had taken their personal property, but in how he had tried to manipulate his victims into thinking he was their friend and would compensate them for their loss if they came and found him the next day.

Fernandez had taken the victims cell phones. He told them that if they gave him $20.00 he would give their phones back and leave them alone. However when one of the victims took out his wallet, the suspect snatched it from him and took $60.00. Fernandez then took a picture of his ID, and told the victim he would “sock him up” if he did not return Friday to give him more money. The other victim also took out $20.00 and handed it to the suspect.

Fernandez was not satisfied, told them to bring more money or he may not “hurt or kill them”. Fernandez then took another picture of the victims “Just in case”, he said. Fearing for their lives they called police to report the robbery.

The manager of the McDonalds was able to show police officers video of the robbery. The victims were able to identify Fernandez through a photo lineup provided by the Sheriff’s department’s correctional data base. The court sentenced Fernandez for six months including time served.

After being released from jail, on March 22, 2014 Fernandez was caught driving on a suspended driver’s license and having marijuana in his possession. Fernandez was charged with violating his parole for the robberies under PC 211/212.5. Last Friday, October 10, after having changed addresses, he was re-arrested on the outstanding warrant. Fernandez is currently being held in the Santa Clara County Main Jail for the parole violation in which he had tested positive for marijuana, and had been driving with a suspended driver’s license. He is expected to be sentenced for the new charges, and has had his probation revoked under Case Number C1354510.

Search Warrant Produced High Sophisticated Lab

SANTA CRUZ—Agents with the Santa Cruz County Anti-Crime Team Narcotics Task Force arrested 34-year-old Justin Morley Pullman after a search of his home produced a highly sophisticated lab for producing ‘honey oil’ which had a street value of over $300,000.00.

On Thursday, October 9, someone called the Santa Cruz Police Department and left an anonymous tip that there was a suspected drug lab in a house on the 100 block of Fairland Way in Santa Cruz.

The Santa Cruz Police turned the information over the Santa Cruz County Anti-Crime Team’s Narcotics Task Force. Armed with the information, the Task Force paid a visit to the neighborhood and contacted a resident at the house, identified as Pullman.

After speaking with Pullman, agents were able to corroborate the information from the tip. They were granted a warrant to look for signs of clandestine butane honey oil, or BHO. The home is located within walking distance of De Laveaga Elementary School, Green Acres Elementary, and Harbor High School.

“BHO labs are very dangerous, Flammable gases are used in the process that extracts THC from Marijuana vegetation.” SCCACT Commander Mario Sulay said, “Should the gases come in contact with an ignition source, such as a pilot light, a dangerous explosion can occur.”

When agents served the search warrant they found a sophisticated high production lab. There was extraction equipment, 41 five-gallon tanks of butane, 96 pounds of marijuana vegetation and 5 pounds of processed concentrated cannabis, commonly known as ‘Honey Oil’.

“We estimate that the marijuana vegetation and buds found would yield an additional 30 pounds of Honey oil.” Commander Sulay said, “That would have yielded a street value of over $300,000.00 dollars.”

Based on what was found, agents with the SCCACT arrested Pullman and transported him to Santa Cruz County Jail. Pullman faces charges of manufacturing a controlled substance and possession of marijuana for sale.  His bail was set at 100,000.00 dollars.

22-year-old Murder Case Reopened, Suspect Arrested

BARSTOW – Twenty-two years after a 25-year-old man was found shot to death in Newberry Springs, investigators have made an arrest.

Gabino Mondragon Morales, 49, of Phoenix, Ariz. has been identified as the suspect in the killing of Fidelmar Meza Garcia, who was 25 at the time of the Jan. 12, 1992 shooting just outside of Barstow. On Thursday, Morales was transported back to California.

San Bernardino County Sheriff’s Dept. homicide investigators interviewed various family, friends and witnesses surrounding Garcia’s murder. Reports stated that Garcia, a migrant worker, lived in the United States for nine months during the harvest season and in Mexico for the other three months.

On Jan. 11, 1992, investigators said that witnesses saw two armed men kidnap Garcia from his Arvin residence. The next morning, he was found shot to death in the San Bernardino County site of Newberry Springs, about 170 miles south of his Kern County residence. Despite what was termed an “exhaustive investigation,” the case went cold, said a county spokesman.

Garcia had worked in the Arvin, Calif. area picking fruit in order to support his wife and child, who remained in Mexico. On July 3, the sheriff’s cold case detectives, Jerry Davenport and Rob Trostle, reopened the case, identifying and locating numerous witnesses, which resulted in evidence identifying the suspect, Morales.

On Oct. 8, cold case detectives traveled to Phoenix, interviewed Morales and subsequently arrested and booked into Maricopa County Jail for Meza’s murder. Meza was booked into West Valley Detention Center in Rancho Cucamonga on a $1 million bail. Detectives did not reveal a motive of the identity of the two people seen kidnapping Meza. The investigation is continuing.

Dying Victim Names Killer

Santa Barbara County - Notwithstanding the frequent portrayal of those suffering a fatal gunshot wound in the movies or on television cop shows, rarely do law enforcement personnel hear dying victims identify their killers by name.

Occasionally, however, reality can mirror theatrical drama, and such appears to have been the case on the night of October 13th when, according to Lompoc Police Department spokesman Sgt. Chuck Strange, officers were dispatched pursuant to a 911 Emergency call reporting “shots fired” in a local area residential neighborhood. Officers arriving at the North Daisy Street home made contact with its resident, Clay Martin Burt Murray, 64, and detained him pending their further investigation of the residence.

After officers checked and cleared the interior of the home, they made their way outside and, as reported by Strange, “as the officers were checking the back yard of the residence, they discovered an adult female that had suffered a gunshot wound to her abdomen.” In spite of what would ultimately prove to be a fatal wound, “she was conscious and able to speak to the officers,” and summarily reported to them that her wound had been inflicted by Murray.

At that point, the woman was rushed to Lompoc District Hospital while officers took Murray into custody. A short time later, while being attended to by emergency medical staff at the hospital, the victim succumbed to her injuries and died. Murray was subsequently booked into Santa Barbara County Jail and charged with murder.

A young man from Fort Bragg must have been following the “Finders Keepers, Losers Weepers” law that he learned on the playground. Christofer Ryan McNeill, 18 of Fort Bragg, must have thought he got real lucky on Monday, October 6.  He answered the door when a UPS deliver person came to his house with a package.

The Driver had a brand new XBox One video game system to deliver to someone in Fort Bragg, but went to the wrong house. McNeill lives on Pudding Creek Road in the more rural northern section of Fort Bragg, north of Pudding Creek. The houses here are more spread out than in the central part of town. When the driver brought the package and asked for the person it was addressed to, McNeill smoothly answered that he was the one.

Observing the name on the box, McNeill signed the receipt, accepted the package, and the driver left. Within the next two days, perhaps because the intended recipient did not get their anticipated XBox, it became apparent to UPS that they had gone to the wrong address. The driver contacted McNeill and told him of the error, and wanted to get the package back. McNeill, however, refused to cooperate, and kept the package.

McNeill displays a gang sign and an apparent assault weapon in a Facebook image.

McNeill displays a gang sign and an apparent assault weapon in a Facebook image.

The UPS driver then contacted the Mendocino Sheriff’s office to report the problem on Wednesday, October 8. When McNeill was identified as the culprit, the Sheriff’s deputies learned that he was on felony probation in the county, with an “obey all laws” clause. His unidentified offence occurred before he turned 18, but exactly one week after his 18th birthday, in December 2013, he was arrested on a probation violation.

According to the Sheriff’s office, deputies contacted McNeill at his home that day, and searching his house, located the purloined XBox. They did not specify, however, if he had opened it and used it yet. He was arrested and booked at the Mendocino County Jail on charges of forgery, receiving property as a result of false impersonation, and a violation of his probation. He was held on a no bail status.

Suspect In Attempted Roadside Shooting of CHP Officer May Stand Trial

Heath Austin Nunes, 38, was dressed in Yolo County Jail garb and present in court in Woodland on October 17 as lawyers discussed the almost two dozen felony charges he may face in connection with his being shot while reaching for a gun in his car parked near Interstate 5.

The incident began as a CHP officer on patrol the evening of Monday, August 18 stopped to make a welfare check after noticing two disabled motorcycles and a car parked on the shoulder of southbound I-5 a few feet north of the County Road 102 offramp in northeast Woodland. The CHP officer quickly ascertained to his satisfaction that the two motorcycles were suffering minor headlight problems and allowed them to leave. According to a Davis Enterprise report, these two riders were affiliated with the Hells Angels. One of the riders said “Nunes was with them,” according the newspaper’s report.

Nunes was found on the side of Interstate 5 in Woodland.

Nunes was found on the side of Interstate 5 in Woodland.

During this discussion, the third person involved walked back to the car and got in. Nunes was later identified as the car’s driver. The first officer who had come on the scene suspected Nunes was perhaps under the influence of alcohol or drugs. He called for backup and four more CHP officers quickly arrived to provide assistance.

The officers approached Nunes in the car and questioned him. Nunes denied he’d done any drinking that evening. Officers ordered him to exit his car. Nunes said he didn’t feel safe, getting out of the driver’s side of the vehicle with freeway traffic going by. But he did say he was willing to take a Breathalyzer test, according to a CHP report. But then Nunes declined to move to the passenger side of his vehicle where one of the officers could administer the test and be safe from freeway traffic.

As this argument grew heated, Nunes allegedly reached for a handgun either on or under his seat. One officer saw the gun, drew his weapon and fired a single round at the driver, who suffered a non-life-threatening wound. Patrolmen immediately administered aid to the driver before he was evacuated by air ambulance to the UCD Medical Center in Sacramento.

A preliminary hearing to determine whether Nunes must stand trial was scheduled for December 22 in Yolo County Superior Court Judge Paul Richardson’s court.

Joseph Yakshin, 23,  was arrested Thursday, October 16, 2014, in El Dorado Hills on suspicion of gross vehicular manslaughter while intoxicated.

According to the California Highway Patrol, Yakshin was the driver of a 1998 Toyota Sienna that ran a red light at the intersection of Walnut and El Camino avenues in Carmichael at approximately 1:00 a.m. on Monday, September 15, striking a Volvo and causing damage to both cars.

Investigators said that after the crash, the driver of the Toyota got out of his vehicle and tried to restart the car three times. When he was unsuccessful, he then fled on foot, police said.

One of the passengers in the Volvo, Deadra Griffin, was taken to a hospital, where she died from her wounds. The driver of the Volvo, Dorrance Byrd, who was Deadra’s boyfriend, and another passenger, Deadra’s sister, were treated for serious injuries.

Hours after the crash, Yakshin called the CHP and reported that someone had stolen his car. That same day, officers took a complete stolen vehicle report from Yakshin in person.

Police launched a monitoring investigation and were able to punch holes in his story, putting him behind the wheel of the car. There is also video of Yakshin going through the intersection at 76 mph before hitting the car that killed Griffin.

Yakshin also faces charges of filing a false police report and driving on a suspended license.

FRESNO – An officer shot and wounded a man who fired a handgun at police during a confrontation in downtown Fresno on Monday morning.

The incident happened around 2:30 a.m. when officers with the Fresno Police Department tried to detain 34-year-old Patrick Lee Hall, who was riding a bicycle and acting suspiciously, according to authorities.

When the officers tried to stop Hall, he took off, heading east on Divisadero past Abby Street. Officers were able to catch up with him in a carport, where Hall tried to physically fight them off. The officers used an electric stun device two times in an attempt to subdue him, authorities said.

It was then that Hall pulled out a handgun. One of the officers made a move to grab the handgun away, prompting Hall to fire at the officer. The officer then pulled out his gun and fired two rounds, one of which hit Hall in the abdomen, police said.

Hall, still carrying his own firearm, jumped a fence in the alley and then tried to enter the backdoor of a home. When he reappeared in the alley near Illinois Street and ran back to Blackstone Avenue, officers were able to catch and handcuff him, police said.

Hall was taken to Community Regional Medical Center to be treated for his wound. He is expected to be released later today. The two officers were also treated at the hospital.

Police found Hall’s gun in the backyard of the home he had attempted to enter, authorities said.

“We’re very, very fortunate today that we do not have a police officer or two shot and killed. Based on the information we have at this time, these officers used incredible restraint,” Dyer said.

SAN BERNARDINO – San Bernardino County Sheriff’s investigators arrested a 37-year-old man suspected for committing sex acts against children.

Investigators said that Armando Gamez-Lopez, of San Bernardino, may have committed more crimes than the three juvenile authorities have already identified as victims. On Monday, court officials said Gamez-Lopez is scheduled to appear in court next month.

Shortly before 9 p.m. on Sept. 25, Deputy Bernabe Ortiz responded to a residence on the 2300 block of West Ogden Avenue, seeking more information about reports of sex against a child. Initial investigation by Ortiz revealed that Gamez-Lopez had been responsible for several related crimes, and also discovered two additional juvenile victims.

Gamez-Lopez, who was not at the location during Ortiz’s initial investigation at West Ogden Avenue, was soon located and arrested without incident, according to reports. He was taken to the West Valley Detention Center in Rancho Cucamonga, held on a $250,000 bond. Gamez-Lopez is facing charges of lewd and lascivious acts upon a child under the age of 14, and also a charge of sexual assault on an animal, according to court documents.

Authorities do not reveal names of the underage victims, nor did they reveal how Gamez-Lopez was connected to them, or gained access to them while committing the alleged crimes.

Deputies, including Ortiz and Detective Ken Marshall, said there may be additional victims related to this investigation, and are seeking others to step forward. Since his arrest, Gamez-Lopez has appeared in Superior Court, facing charges. His next court appearance is scheduled for Nov. 18, according to court documents.
