21-year-old Robert Leon was arrested on Aug 22 and booked into the Santa Clara County Main Jail for exhibiting a knife, a violation under PC 417.8. According to the Santa Clara District Attorney’s Office, Leon is scheduled to appear before a Superior Court Judge on Sept 16 at 9:00 am in Dept 39 for the offense. Leon is also being charged with other crimes when Loss Prevention Employees witnessed Leon stealing clothing and other items from a Target store located at 554 Coleman Avenue in San Jose. Leon was charged under PC 484-488, for petty theft and also one misdemeanor account PC 148 (a) (1), for resisting arrest.
SJPD Officers located the suspect near the area of St. John Street and Autumn Street, several miles away from the scene, on his bicycle. Officers were dispatched to the area after a report of an armed robbery. The description of a possible armed robbery suspect matched Leon’s description.
When SJPD Officers approached Leon as the possible suspect, he began to fight with officers. During the struggle he suffered several scrapes and bruises, as officers forced him to the ground in order to handcuff him. SJPD Officers also reported having strained hands and fingers while trying to handcuff the suspect during the struggle.
The suspect was carrying a bottle of Bacardi Rum valued at $11.99 with a Target Safety Device still attached. There was also a package of Duracell batteries valued at $13.79 located in his backpack. Security officers also suspected that Leon had placed a shirt and pants into his backpack. However, these items were never located. When Leon was confronted by employees who had attempted to detain him, he moved the hoodie he was wearing to show a large knife attached to his hip. The Loss Prevention Employees became fearful of being attacked and “disengaged” from the suspect, allowing him to run out of the store.
Store employees gave SJPD officers several surveillance photos of the suspect, and they were taken into evidence. It was then an officer on patrol after being dispatched to the area spotted a possible suspect carrying a backpack matching the description given to officers by store employees. The backpack was booked into evidence with other miscellaneous items including rope, a plastic fork, and a pair of metal pliers.
