SAN JOSE – Domestic abuse in San Jose has become a serious problem, with more than five arrests occurring during the week as a result of drunken and disorderly behavior that has often led towards physical abuse in the home. However, this increase in violent behavior can also occur outside of a current relationship.
During a recent domestic dispute 35-year-old Ubaldo Juarezascencio was arrested and charged with malicious harassment for making a credible threat against a female victim, whom he had intended to intimidate to cause her to fear for her safety. This after a one-year relationship between them that was ended due to battery in the home.
Juareszascencio is expected to appear for a jury trial set on Aug 26, 2013 starting at 9:00 am in Dept. 46. He is being charged with PC 646.9 – for willfully and maliciously harassing another person and who makes a credible threat. He is also being charged under PC 242/243 (e) – battery against a person he was once dating.
Juareszascencio, during April 1 – April 30, was charged with battery, leading to the dissolvement of their relationship. Then on July 27, 2013 Juareszascencio called his ex-girlfriend on the phone several times threatening her safety. During this recent run-in the victim told police that “the suspect had called the victim over 50 times throughout the day.” Juareszascencio was told that he was not welcome and was asked to stop phoning, however he continued to harass and phone the victim, telling her he did in fact intend to come over to her place. During several threatening phone calls he told the victim that he would steal her vehicle and other property from her.
The victim had been in a relationship with Juareszascencio for about one year when the relationship ended. According to police, Juareszascencio stated, “He couldn’t live without her and would harm her and anyone who dated her.” They had been separated for three months when she saw him follow her in his vehicle. Police considered this case a stalking case due to the nature of the suspect’s actions, involving following the victim in his car, and that of repeated threatening phone calls.
An Emergency Protective Order was issued against the suspect after the victim requested that officers help keep Juareszascencio away. Juareszascencio was found at the victim’s residence, where he had knocked several times on her door and window trying to harass her and make her open the door for him. When police arrived to her residence they found Juareszascencio standing on a 5-gallon bucket looking into her bedroom window. Police took Juareszascencio into custody, and booked him into the Santa Clara County Main Jail without incident.
