On September 18 in the City of Milpitas 19-year-old Edward Leal was arrested for the crime of Vandalism under PC 594(a)/(b)(1), a misdemeanor. Leal is being charged with breaking several windows in a home located at 454 Coelho Court.
A call was received by the 9-1-1 dispatch center around 11:34 am. The call reported that an individual staying at the home had broken four windows inside the residence with an estimated value of more than $1200. When Milpitas Police Officers arrived at the scene, Leal had become combative and swore and yelled at police, telling them to leave. The officers responded to Leal that they could not leave until they had checked the house and insured that everyone was safe. He assured officers that everything was fine.
Officers asked Leal what had happened. They reported that he told them “he came home in the morning and his mother had kept yelling at him.” Leal reportedly said that “His mother kept yelling at him and slapping him on the head.” Leal told them that he tried to go away from her when she followed him down the stairs, and she continued to yell and slap him in the head. He said he just “lost it”.
Leal said he never hit his mother and just was so angry at her hitting him in the head and face that he just started breaking windows. He did not remember what he broke the windows with. Officers questioned his mother about the assault, and she said she had hit him with her right hand with an open palm on the left side of the face after Leal had called her a (deleted). Leal did not want his mother arrested for battery, and he was taken to the Santa Clara Main Jail for booking.
Leal was released from the Main Jail under an order for the release on: Supervised Own Recognizance, with a stipulation that he could not reside at the residence he had vandalized. Leal’s next court appearance has been set for expected on 10/21/13 at 1:30 in Dept. 52.
