SAN JOSE – Investigative officers working prostitution enforcement detail in San Jose arrested 22-year-old Darrion Mayno Bolden from Vallejo on July 29, 2012 for the crime of Pimping under PC 266h (a), a Felony. Bolden was in court on January 18 facing a release from jail under PC 1203.065(a), in which Bolden would be refused probation for the charges that he attempted to pimp and/or support prostitution of a minor.
On January 7, the defendant filed a motion under 1538.5 to dismiss evidence on the grounds of unlawful search and seizure conducted by police at the time of his arrest. The motion seeks to suppress evidence filed against him by officers, and any statements he may have given at the time of his detainment and arrest. The defendant is claiming a violation of his fourth amendment rights because he feels the search and seizure of his person was illegal at the time.
On January 14 the D.A. filed their opposition to the defendant’s motion to suppress evidence. The location of the defendant, coupled with suspicious behavior, flight and apparent interest of activities occurring at the scene were acknowledged as a cause of action when officers initially detained the defendant.
Bolden had been arrested and booked into the Main Jail under PC 266(h), after he was found parked in an empty parking lot where he oversaw sexual acts performed by a minor he was actively encouraging to participate in prostitution. The lot was located near Monterey Road , Alma Ave, and Stauffer Blvd in San Jose.
During a later Prostitution Enforcement Detail, Investigative Officers and other assigned units observed a female standing in the area of Monterey Road and Stauffer Blvd. Because of the concern for the safety of the general public, police are alert about possible robberies that may be linked to luring men to isolated locations and then robbing them.
On January 20, 2013, San Jose Police officers arrested two individuals who were found on Stauffer Blvd. 23-year-old Jonathan Powell and 22-year-old Keenan Reese, both from Fresno, were arrested for PC 25850(a) carrying a concealed firearm in their vehicle, PC 211, Felony Robbery, PC 4574 Weapon/Tear Gas, and PC 496 Possession of stolen property. These individuals were identified by officers as having committed several robberies in the area, following up on a report by a person of being robbed near Monterey and Stauffer near Gold’s Gym, located at 1893 Monterey Rd. It is not known if they were connected to any prostitution activities that may have been going on at the location.
