Following the arrest of 25-year-old Mark Ryan Flores, a felony complaint was filed on May 08, 2013. Flores was arrested on May 5, 2013, for shooting at an occupied vehicle under PC 246. Flores is also being charged with two counts under PC 664 (a)-187, in the attempted murder of two individuals near McKee and King Roads in East San Jose, in which Flores intentionally fired a shot gun under PC 12022.53(c) and 12022.53 (b).

Flores was spotted by patrol officers a short time later driving at a high rate of speed, nearly missing an unmarked Metro unit patrol car. Flores had tried to make a sharp turn causing the officers to move forward to avoid being hit by the moving vehicle. Reacting quickly, officers made a U-turn in pursuit of the speeding vehicle. At the time the of the chase, a call came over the radio stating that a person had flagged down a SJPD officer who told them he was just shot at by a person in a white Chevy Impala occupying two Hispanic males. Flores had fired a black shotgun into an unsuspecting driver’s vehicle.
Flores had recently been released from prison on State Parole for a similar charge under PC 246, in which he had shot at an occupied vehicle under gang allegations under PC 667.5(c) /1192.7 (c). He had served a term of 5-years. However, with new allegations Flores now faces a prison term of 10 – 20 years for the shooting.
2610 Rivermont Ct., San Jose
Officers located the vehicle at 2610 Rivermont Ct. Police were warned by witnesses that an individual jumped their fence to escape to the opposite street. Officers set up a perimeter search and were able to apprehend Flores without incident. Another witness at the scene saw a male running from white Chevy Impala who was carrying a black gun that he later tossed into the gutter. She then saw her neighbor seated in a parked car near the curb get out from his car and pick up the gun from the gutter, then walk back to his car and get in. The individual was identified as Dustin Conner who also lived in the neighborhood near Clyda Dr. and Dobern Ave.
When a person tampers with evidence and is caught trying to help another person evade authorities, it becomes a Felony offense under PC 32. This case is believed to stem from continued gang violence associated with the results of gang influence and drugs in the neighboring area.
