21-year-old Ray Ledesma appeared in court on January 11th in a brief appearance for the charges of Murder under PC 187. The San Jose Police Homicide Investigations Unit has identified 18-year-old Dashawn Brown, of San Jose, as the victim in a homicide that occurred on the 5100 block of Monterey Road in San Jose.

25-year-old Vincente Hericilio Duarte is also being charged in the case for harboring, and or concealing and aiding Ledesma under PC 32 for helping him evade authorities. He is also being charged under PC 186.22 (b) (1) (A) in the offense promote further attends that Duarte actively participated with a criminal street gang for the intent to commit murder.
On March 8, 2012, a 9-1-1 call was received by police dispatchers reporting that a person had been shot. When SJPD officers located the victim, Brown was found to have been shot multiple times. He was transported to Valley Regional Medical Center where he was pronounced dead from multiple gunshot wounds at 10:36 pm. Police working with investigators were eventually able to determine the identity of the shooter, and were later able to arrest Duarte who was actively helping Ledesma evade capture by police.
The Supervising Deputy District Attorney in the case Peter Waite said, “Ledesma has two cases.” Ledesma has a preliminary hearing for a gun charge on Jan 24, 2013 at 8:30 am, in courtroom 23 and another preliminary hearing for the murder charge of Dashawn Brown on January 25, 2013 at 1:30 pm. Waite said, “He is also facing a third strike conviction for both the gun possession charge and murder case.”

Ledesma has a two-strike prior felony conviction. “The gun possession and murder case will be assigned out to a court were the case will be heard,” Waite said. Dashawn Brown was killed in the drive way entering a small shopping center with a Liquor Store, Hair Saloon, and Tax Service. A person working in the hair salon said he had seen Brown in the parking lot, “I saw him lying down on the ground against the curb with his head facing towards this way,” he said.
